Whistle Blowers Act, Lokpal Act and CVC Vigilance Manual: UPSC Notes

Vigilance administration in India draws on the Central Vigilance Commission Act, 2003, the Lokpal and Lokayuktas Act, 2013, CVC’s Vigilance Manual and the Public Interest Disclosure and Protection of Informers (PIDPI) mechanism. Crucially, the Whistle Blowers Protection Act, 2014 was enacted but, according to the Government’s December 2025 parliamentary reply, had not been brought into force. Do not confuse the PIDPI complaints mechanism with commencement of that Act.

Lokpal: sections to prioritise

SectionSubject
3Establishment of Lokpal
4Appointment of Chairperson and Members
11–12Inquiry Wing and Prosecution Wing
14Jurisdiction over specified public functionaries
20Complaints, preliminary inquiry and investigation
21Hearing persons likely to be prejudicially affected
23Sanction for initiating prosecution
63Establishment of Lokayukta

The Lokpal law is not limited only to Group A officers; its section 14 coverage is broader, subject to statutory conditions. Read precise exceptions, procedure and jurisdiction from India Code.

Vigilance workflow and distinction from disciplinary action

  1. Receipt and screening of complaint under appropriate complaint-handling rules.
  2. Examination of jurisdiction and the nature of allegations.
  3. Preliminary verification/investigation by competent authority where warranted.
  4. Decision on further vigilance or disciplinary action, considering applicable CVC/DoPT instructions.
  5. Opportunity and procedure under relevant service disciplinary rules; criminal prosecution follows a different legal route.

Preventive vigilance seeks to reduce corruption opportunities, often via transparent procurement, rotation and control systems. Punitive vigilance concerns response to detected irregularity/misconduct. Participative vigilance involves awareness and stakeholder contribution.

Important legal-status caution for Whistle Blowers Act

The Government told Parliament on 11 December 2025 that no commencement notification had been made under section 1(3) of the Whistle Blowers Protection Act, 2014. A 2015 amendment Bill was passed by Lok Sabha but lapsed. Until a later commencement notification can be verified, the safe statement is enacted, but not brought into force according to the latest official parliamentary reply verified for this article; this is not equivalent to ‘fully operational’.

PIDPI disclosures and CVC complaint-handling instructions remain a separate source of administrative procedure. For more detail see CrackTarget’s dedicated vigilance chapter.
