BSA 2023 — Evidence Law & Electronic Records Study Guide
A practical route into the Bharatiya Sakshya Adhiniyam, 2023: facts in issue, relevance, burden, witnesses, documents and electronic records.
Separate three legal questions
First ask whether evidence is relevant; second whether it is admissible under the Act; third what weight it deserves after evaluation. A relevant assertion does not automatically become sufficient proof.
Electronic and digital records
Sections 61–63 address electronic or digital evidence. Section 63 governs admissibility of specified electronic records subject to statutory conditions and certificate requirements. Avoid oversimplified rules: refer to the complete provision and applicable case law.
High-yield areas
Facts in issue and relevant facts; admissions and confessions; burden of proof; estoppel; witness competence and examination; documentary and electronic evidence.
Use older Evidence Act PYQs correctly
The old Indian Evidence Act section 65B is a common reference in previous papers. Compare its subject with BSA section 63 using the official text and watch for changed language or schedules.
Primary sources & further reading
Use the primary documents when a question depends on a section number, time limit, definition, amendment or recruitment condition.
