Vigilance Administration: CVC, Lokpal, PIDPI and Whistle Blowers Protection Act

CRACKTARGET · UPSC SPECIALISED RECRUITMENT · GUIDE 09 / 10

Vigilance administration includes prevention, complaint handling, inquiry and disciplinary coordination. The CVC, departmental CVO, Lokpal and disciplinary authority have distinct functions. Study the Whistle Blowers Protection Act separately from PIDPI, and always distinguish enactment from commencement before describing a statutory mechanism as operational.

Current-text discipline

A parliamentary reply dated December 2024 stated that no commencement notification had then been issued for the Whistle Blowers Protection Act. Treat that as a dated official statement. Verify later Gazette notifications before asserting the same position for a later date.

For the Vigilance Manual, record the edition used and read later CVC circulars alongside it. Official search results also surface a 2026 manual edition; the older 2021 manual should therefore not be labelled the latest merely because it is widely circulated.

Preventive versus punitive vigilance

Preventive vigilance reduces opportunities for wrongdoing through transparent processes, clear responsibility, rotation where applicable, audit trails and early identification of weak controls. Punitive action concerns established allegations and the applicable legal or disciplinary process.

A purchase file can reveal both dimensions. Poor specifications may indicate a training or control problem. Tailoring specifications to favour a connected supplier raises a different concern. Establish the facts rather than treating every procedural error as proved corruption.

Complaint handling: an examination framework

Identify jurisdiction, the nature of the allegation, the supporting material and the applicable complaint procedure. Preserve confidentiality as required. Route the matter to the competent channel without casually circulating sensitive identities.

A complaint may raise a corruption allegation, an ordinary service grievance or an appeal against an administrative decision. The correct route depends on that distinction. A person unhappy with a posting does not automatically have a Lokpal complaint.

Lokpal: scope and safeguards

The Lokpal’s statutory jurisdiction includes specified public servants and covers the Prime Minister subject to important exclusions and procedural safeguards. Avoid the inaccurate extremes that the Prime Minister is wholly outside jurisdiction or that the jurisdiction is unrestricted.

Separate preliminary inquiry, investigation, prosecution-related steps and departmental action. These terms describe different stages or processes; an allegation becoming a complaint does not mean that guilt has been established.

The vigilance angle in a case

Suppose a bidder alleges that a tender officer disclosed competing prices. Ask what access the officer had, what was disclosed, when it was disclosed, who benefited and what records exist. The inquiry should examine evidence and responsibility.

Now compare an employee who transposes a figure and immediately reports the error before payment. The facts may call for correction and accountability, but the same conclusions cannot be assumed without examining intent, circumstances and applicable instructions.

CVC advice and disciplinary action

Vigilance advice and the disciplinary authority’s statutory responsibility are distinct. Learn the applicable consultation requirements, decision process and reporting obligations from the current manual and circulars.

In a scenario question, choose the option preserving competent authority, evidence and due process. Do not assume that an advisory observation eliminates the employee’s procedural safeguards or automatically supplies proof of every charge.

A revision matrix for vigilance exams

Build five columns: institution, legal source, jurisdiction, process and safeguard. Add a sixth for amendments or circulars. Use a separate page for PIDPI requirements so that they are not mixed with a general complaint.

Practise short distinctions: anonymous versus identified complaint; grievance versus corruption allegation; prevention versus punishment; inquiry versus investigation; enactment versus commencement. These distinctions help solve unfamiliar case questions.
